If you do not agree with these Terms, you must not access or use the Platform.

- You must be at least 16 years old to use the Platform. If you are under 18, you must have parental or guardian consent to use the Platform.
- You must provide accurate and complete information when creating an account or submitting content, such as reviews or business details.
- You are responsible for ensuring your use of the Platform complies with all applicable local, national, and international laws and regulations.
- We reserve the right to refuse access to the Platform to any individual or entity at our sole discretion.

- To access certain features, such as posting reviews or managing a business listing, you must create an account with accurate information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

- User Content: You may submit content, including reviews, ratings, comments, or business profile information ("User Content"). By submitting User Content, you grant CheckReview.net a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute the content for Platform operations, promotion, and related purposes.
- Content Guidelines: User Content must not:
  - Contain false, misleading, or defamatory information.
  - Violate third-party intellectual property rights, including copyrights or trademarks.
  - Include hate speech, harassment, or discriminatory language.
  - Promote illegal activities, spam, or unsolicited advertising.
  - Contain personal data of others without their consent.
- Conduct: You agree not to:
  - Engage in review manipulation, such as posting fake reviews or incentivizing feedback.
  - Use automated tools, bots, or scripts to access or scrape the Platform without permission.
  - Attempt to interfere with the Platform’s security, integrity, or functionality.
  - Impersonate another person or entity.
- We reserve the right to remove or edit User Content that violates these Terms or our policies without notice.

- Businesses may claim or create listings on the Platform, subject to our Business Terms & Conditions (available at https://www.checkreview.net/business-terms).
- Users may post reviews and ratings based on genuine experiences with businesses listed on the Platform.
- Businesses may respond to reviews publicly, provided responses are professional and comply with our content guidelines.
- We do not mediate disputes between users and businesses but may provide tools to facilitate communication.
- Reviews that violate our guidelines may be removed, but we do not remove reviews solely at a business’s request unless justified by policy.

- Our Content: The Platform’s design, code, logos, and content (excluding User Content) are owned by CheckReview.net and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use our content without written permission.
- Your Content: You retain ownership of your User Content but grant us the license described in Section 3. You are responsible for ensuring your content does not infringe on third-party rights.
- If you believe your intellectual property rights have been violated, contact us at [email protected] to submit a complaint.

- Businesses may purchase premium services, such as sponsored listings or enhanced visibility, subject to our Business Terms & Conditions.
- All payments are processed through secure third-party providers. Payments are non-refundable unless otherwise stated in writing.
- Purchasing premium services does not guarantee specific outcomes, such as improved reviews or increased customer engagement.
- We reserve the right to suspend premium services for accounts that violate these Terms.

- Our collection, use, and protection of personal data are governed by our GDPR Policy (available at https://www.checkreview.net/gdpr-policy).
- By using the Platform, you consent to our processing of your personal data as described in the GDPR Policy.
- You are responsible for ensuring any personal data you submit about others (e.g., in reviews) complies with applicable data protection laws.

- The Platform is provided on an "as-is" and "as-available" basis. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
- We do not endorse or verify the accuracy of User Content, including reviews or business information.
- We are not liable for any losses or damages resulting from your use of the Platform, including but not limited to reliance on reviews or business listings.
- We are not responsible for resolving disputes between users and businesses or for any transactions conducted outside the Platform.

- To the fullest extent permitted by law, CheckReview.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or opportunities.
- Our maximum aggregate liability, if any, is limited to the amount paid by you for premium services in the twelve (12) months preceding the claim, or $100, whichever is greater.
- You agree to indemnify and hold CheckReview.net, its affiliates, and employees harmless from any claims, damages, or liabilities arising from your breach of these Terms or misuse of the Platform.

- We may suspend or terminate your access to the Platform without notice for violations of these Terms, suspected fraud, or misuse of the Platform.
- Upon termination, you will lose access to your account and any associated content. We are not obligated to refund any payments for premium services.
- You may request account deletion by contacting us at [email protected], subject to verification.
- We may retain certain data as required by law or for legitimate business purposes after termination.

- We may update these Terms at any time. Changes will be effective immediately upon posting to the Platform with the revised effective date.
- Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
- You are encouraged to review these Terms periodically to stay informed of any updates.

- These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.
- Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
- You agree to submit to the personal jurisdiction of these courts for resolving disputes.
- Before pursuing legal action, you agree to attempt informal resolution by contacting us at [email protected]. If unresolved within thirty (30) days, either party may proceed with legal action.

- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.
- Entire Agreement: These Terms, together with our GDPR Policy and Business Terms & Conditions, constitute the entire agreement between you and CheckReview.net regarding the Platform.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights at our discretion.
- Force Majeure: We are not liable for failures to perform due to events beyond our control, such as natural disasters or cyber-attacks.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
